Terms and Conditions

IN OUR TIME 2027

Project terms and conditions

Version: 23 October 2026

1. Organiser and contact

IN OUR TIME is organised by SUSSEX CONTEMPORARY LTD (SC), a private limited company registered in England and Wales, company number 13892611, incorporated on 3 February 2022. Its registered office is 28 Dellney Avenue, Haywards Heath, RH16 3ND, United Kingdom.

Project correspondence and artwork delivery address: FAO Jo Myles, SUSSEX CONTEMPORARY, 28 Dellney Avenue, Haywards Heath, RH16 3ND, United Kingdom.

Customer-service email: hello@sussexcontemporary.com

These terms cover artist participation and purchases of IN OUR TIME artworks through our website. Please read them before ordering and retain your order confirmation. Nothing in these terms limits rights that cannot lawfully be excluded.

2. Participation and what is included

The project welcomes UK and French artists and creatives. There is no selection panel or competitive judging. Each purchased place includes one supplied A5 canvas-covered board, exhibition inclusion for a compliant work delivered on time, a listing in the printed and online catalogues, and a private view invitation for the participant and a guest.

Participation costs £40, inclusive of applicable VAT. Delivery and optional return postage are additional. The fee pays for participation and does not guarantee an artwork sale, press coverage or a particular position in the display.

Your participation booking is accepted when we send confirmation accepting it. If we cannot accept it, we will tell you and refund any payment taken. Anyone contracting must be at least 18; a parent or guardian must make and manage a booking for a younger contributor and arrange the necessary permissions.

3. Dates and venue

Entries close on Friday 9 July 2027 at 23:59 UK time. Catalogue information is due by Thursday 22 July 2027 at 23:59 UK time. Completed artworks must arrive by Friday 30 July 2027. Please enter early enough to receive your board, create your work and send it to us, particularly from France.

The public exhibition runs from 21 August to 12 September 2027 at the Atrium, Marine Workshops, Railway Approach, Newhaven, East Sussex, BN9 0ER. Opening hours are Thursday to Saturday, 11am–4pm, and Sunday, 11am–3pm. Public admission is free. The final closing time is 3pm on Sunday 12 September.

We will explain how to submit catalogue information. Please provide accurate details, including the artist name, artwork title, medium, selling price and any requested image or statement. We will make reasonable efforts to correct errors reported before printing. Late information may miss the printed catalogue; we will contact you about available alternatives.

4. Artwork requirements

Use the supplied A5 canvas-covered board, measuring 148 × 210mm, in portrait orientation. The maximum total depth of the completed work, including the board and surface texture, is 1cm. Work must remain within the edges of the board and must not be framed. Three-dimensional artworks are outside this project.

You choose your subject and medium. Materials must be dry, stable, securely attached and suitable for handling and public display. The completed artwork and protective wrapping must fit in the project postal box with the lid fully closed and without bulging. Please contact us before making the work if your materials need unusual handling.

You must own the work and have the right to exhibit and sell it. Obtain permission for any third-party material where required. Do not submit work that infringes copyright, privacy or other legal rights, or material whose display would be unlawful.

We may decline work that fails these published requirements or cannot safely or lawfully be displayed. This is a compliance check, not artistic judging. Where practicable, we will explain the issue and offer a reasonable opportunity to resolve it. We will assess any refund fairly under section 11, taking account of the reason and services already provided.

5. Boards, postage and delivery to SC

The entry options are: board collection £40; UK board delivery £43; UK board delivery and return of unsold work £46; France board delivery £46.50; France board delivery and return of unsold work £54.50. These are total option prices, including applicable VAT. Return postage is for unsold work to the specified address.

Free board collection is from Seawhite’s showroom in Partridge Green on presentation of your order confirmation, during its collection hours. Posted boards include a reusable project box and an address label for sending the completed work to SC. The label is not prepaid.

We will supply the board within 30 days of acceptance unless a different timeframe is expressly agreed before ordering. Please contact us promptly if a board is delayed or damaged so that we can resolve the issue. We remain responsible for delivery of boards we send until you or your nominated recipient receives them, subject to any applicable statutory exception.

You arrange and pay for delivery of your completed artwork to SC, allowing for transit and customs. Include your name and order number and use secure protective packaging. Retain proof of sending; tracking and appropriate transit cover are recommended. If we arrange a collection service separately, its price and terms will be agreed first.

French shipments require accurate customs declarations. Any taxes, duties or carrier charges not included in our quoted price will be explained where applicable and remain payable by the responsible party under the relevant customs rules. Please contact us before sending if arrangements are unclear; do not describe sold goods or commercial shipments as gifts.

6. Display and care

Artworks will be presented in one continuous line, with no gaps, subject to the venue’s practical and safety requirements. SC decides the order and installation arrangements. Works must remain available for display until the exhibition closes, except where removal is reasonably necessary or agreed with you.

Artists are responsible for maintaining their own public liability insurance appropriate to their participation and the materials used in their artwork. Public liability insurance addresses claims for injury or damage to others; it does not ordinarily insure the artist’s own artwork against loss or damage. Artists should check their separate artwork and transit insurance arrangements for periods outside SC’s confirmed cover. These insurance requirements do not exclude or reduce SC’s liability for loss, damage or injury for which it is legally responsible.

SC will exercise reasonable care and skill while handling, storing, installing and packing work. Please tell us about any existing damage or particular handling requirements. SC arranges insurance for artworks while hung in place in the exhibition, subject to the insurer’s policy terms, valuation basis, limits and exclusions. The scope of this cover will be confirmed before artworks are delivered. Cover during transit, storage, installation and removal is not confirmed by this clause.

7. Pricing, commission and authority to sell

All submitted artworks must be available for sale. Artists set their own selling price in pounds sterling. SC’s commission is 30% of the artwork selling price, including VAT on that commission. The artist receives 70%. For a £100 artwork sale, the artist receives £70 and SC retains £30. We do not deduct an additional transaction fee from the artist’s 70% share.

By participating, you appoint SC as your disclosed sales agent for the submitted artwork and authorise SC to display and market it, accept orders at your agreed price, collect payment and administer delivery, lawful cancellations and customer remedies on your behalf. You agree to the buyer protections in sections 13–15 as terms of sales made through this project. We will obtain your agreement before offering a discretionary discount. You must not sell the submitted work elsewhere while it is offered for sale through this project unless we agree otherwise.

Buyer delivery charges are separate from the artwork price. They are paid by the buyer to cover the agreed delivery service and are excluded from the 70/30 artwork split.

The artist retains ownership until a valid sale transfers it to the buyer. Buying an original artwork does not transfer its copyright or reproduction rights.

8. Artist payments and refunds affecting sales

Artist payments for completed, paid sales are scheduled for 1 October 2027. Please provide accurate bank details through the method we specify. We will send a sales statement. Payment may be delayed only for a genuine outstanding issue, such as missing bank details, uncleared funds or a pending cancellation, return or payment dispute; we will explain the reason and pay any undisputed balance on time.

Online sales may be cancelled or refunded under consumer law. If a sale is lawfully reversed, the artist is not entitled to retain the proceeds of that reversed sale and SC will reverse its corresponding commission. If the artist has already been paid, we will provide evidence and agree repayment of the relevant artist share or a credit against other sums with the artist. A cancellation caused by SC’s own breach will not automatically be charged to the artist.

We will consult the artist about returns and disputes where practicable without delaying the buyer’s rights. Any responsibility for additional losses will depend on the cause and applicable law; it is not an automatic unlimited liability for the artist. If returned work is unsold, we will arrange its collection or return with the artist.

9. Collection and return of unsold work

Unsold work may be collected from the Marine Workshops on Monday 13 September 2027 between 10am and 3pm. Bring your order confirmation or arrange written authority for someone else to collect it.

Alternatively, return postage costs £3 to a UK address or £8 to France. UK returns use Royal Mail Second Class; French returns use Royal Mail International Standard. The France price covers a packed work up to 500g; contact us before entering if your work will exceed that weight. Any different service or additional charge must be agreed before dispatch.

You may purchase return postage with entry or add it later using a payment link. If already paid, no additional payment is needed for the agreed service. We will confirm dispatch arrangements after the exhibition and use suitable protective packing. Please keep your address current.

If work is neither collected nor covered by paid return arrangements, we will contact you to agree a solution. We will not treat it as abandoned or sell, donate or destroy it simply because the collection date has passed. Any later storage charge or disposal process must be lawful, proportionate and preceded by the required notice.

10. Copyright, images and personal information

Artists retain copyright. You grant SC a non-exclusive, royalty-free licence to reproduce images of the submitted work and the supplied project text for the printed and online catalogues, exhibition interpretation, project promotion, sales listings, reporting and archival records. This permission does not authorise unrelated merchandise, sale of reproductions or AI training.

We will credit the artist where reasonably practicable and will not materially alter an image of the work without agreement, apart from normal resizing or layout adjustments. Images already printed, distributed or held in the project archive may remain after the exhibition; requests concerning future promotional use can be discussed with us.

We use personal information to administer bookings, delivery, cataloguing and sales, in accordance with our website privacy notice. Public listings use the agreed artist information; we do not publish bank details or private addresses. Marketing subscriptions require a separate lawful basis and are not a condition of participation.

11. Artist cancellations, refunds and changes

SC does not offer discretionary change-of-mind refunds for artist participation. Booking reserves a place in the dated exhibition and commits SC to project delivery. This policy does not exclude statutory cancellation rights, remedies for a failure by SC to provide the agreed service, or refunds required by law. No additional voluntary 14-day artist cancellation period is offered.

Where a statutory cancellation right applies, notify us by email or post using the contact details in section 1. We will provide any refund, return arrangements and timescales required by law. For goods returned following a statutory change-of-mind cancellation, the participant pays direct return postage where this has been disclosed before purchase; SC covers reasonable return costs for a faulty or incorrectly supplied board. A deduction for diminished value or a service already supplied will be made only where legally permitted.

We will not deduct for project services supplied during a statutory cancellation period unless the legal requirements, including any necessary express request to start early and prior information about proportionate costs, have been met. Accepting these terms alone is not such a request.

If you withdraw, miss a deadline or cannot comply with the artwork requirements, contact us promptly. Where retaining a fee operates as a cancellation charge, we will retain only a lawful, reasonable amount reflecting services already supplied and evidenced net losses caused by cancellation, after savings and reasonable steps to reduce those losses. We will explain the calculation and refund any amount that we are not entitled to retain.

If SC cancels the exhibition without providing the agreed participation service, we will refund the participation fee and unused optional services and arrange a return solution for artworks already held. For a material change of dates, venue or promised service, we will notify you and offer a fair cancellation and refund option. We will not remove statutory remedies by relying on circumstances outside our control.

12. Buying an artwork: seller and ordering

SC acts as a disclosed sales agent for the artist named in the artwork listing. The contract for purchase of the artwork is between the buyer and that artist, who is the legal seller. The seller’s legal identity, required contact information and whether they act as a trader will be disclosed before purchase and confirmed with the order. SC is authorised to accept orders, collect payment and administer delivery, cancellations, refunds and complaints on the artist’s behalf. SC is the buyer’s first point of contact for these matters. This agency arrangement does not remove any legal responsibility SC has for its own services or conduct.

Each participating artist authorises SC to offer the buyer protections in sections 13–15 as terms of the artwork sale, including where the artist is not acting as a trader. These contractual protections do not reduce any additional statutory rights. Each listing describes the artist, artwork, medium, dimensions and price. Screen colours may vary, but this does not remove the requirement for the work to match its description.

Payment is required at checkout. A sale is accepted when an acceptance confirmation is sent; an automated payment acknowledgement alone need not be acceptance and must be clearly identified as such. If a unique work is unavailable or there is a material listing error, we will contact you and refund any payment if the order cannot be fulfilled. We will never substitute another work without consent.

13. Buyer collection and paid delivery

Artworks remain on display until the exhibition closes on 12 September 2027. Buyer collection is available on Monday 13 September, 10am–3pm, from the Marine Workshops, unless another arrangement is agreed.

Delivery is available at the buyer’s cost through our website for supported destinations. The complete delivery charge and applicable delivery timeframe must be shown at checkout or agreed in writing before the buyer commits to the purchase. Any quote-only destination requires an agreed quote before sale acceptance. No optional charge is added without consent.

Works purchased before the exhibition ends will be dispatched after it closes. Before checkout we will make clear that delivery is deferred until after the exhibition and give the agreed delivery window; this must be expressly agreed where it extends beyond 30 days after purchase. We will notify buyers of delays and honour applicable cancellation and refund rights.

We will package works appropriately and arrange the paid service. Responsibility for a consumer delivery remains with the legal seller until the buyer or their nominated recipient takes physical possession, except where a statutory exception applies, such as a carrier independently commissioned by the buyer and not offered by us. Buyers should contact SC about a missing or damaged delivery; they will not be required to pursue our carrier as a substitute for their rights against the seller.

Any applicable import taxes and duties, and who pays them, must be made clear before an international order. We will not charge an unagreed delivery supplement after purchase.

14. Buyer cancellations and returns

For online artwork purchases, buyers may cancel from ordering until 14 days after the day they or their nominated recipient receive the work. This applies to an existing original artwork; being unique does not by itself make it a personalised commission.

Notify SC by email or post using the contact details in section 1, giving the order number and a clear statement of cancellation. The cancellation form below is optional. Return the work within 14 days after notifying us, to the address we confirm. For a change of mind, the buyer pays direct return postage, as disclosed before purchase. Suitable protective packing and proof of sending are recommended.

We will refund the artwork price and the least expensive standard outbound delivery offered for that order. A premium delivery upgrade need not be refunded beyond that standard amount. We may deduct only for diminished value caused by handling beyond what is needed to establish the work’s nature, characteristics and functioning, where legally permitted; there is no cancellation or restocking fee.

Refunds use the original payment method without a refund fee and will be issued within 14 days after we receive the return or evidence of sending it, whichever is earlier. If no goods were supplied, or we offered collection, the applicable refund period runs from notification of cancellation. These terms do not extend any period allowed by law.

For a purchase concluded entirely in person at the exhibition, we do not offer an automatic change-of-mind return unless agreed at sale. Rights concerning faulty or misdescribed work remain. An online purchase is not treated as an in-person sale merely because the buyer collects it.

15. Faults, damage, complaints and legal rights

Goods must be of satisfactory quality, fit for any agreed purpose and as described. If a board or purchased artwork is faulty, damaged on arrival or misdescribed, contact SC promptly with your order details and, if practicable, photographs. Photographs or reporting within an arbitrary short deadline are not conditions of your statutory rights.

Where UK consumer law applies, this can include a 30-day short-term right to reject faulty goods and further remedies after that period. We will provide the remedy required by law and cover reasonable return costs for a justified faulty-goods return. The uniqueness of an artwork does not remove these rights; an identical replacement may not be possible.

Please send complaints to the contact in section 1. We will investigate and explain our proposed resolution. If unresolved, we will provide any legally required information about an appropriate alternative dispute resolution provider and whether we will participate.

We are responsible for foreseeable loss caused by our breach or failure to use reasonable care and skill. We do not exclude liability for fraud, death or personal injury caused by negligence, or anything that cannot lawfully be excluded. A carrier’s compensation limit does not automatically cap a buyer’s statutory remedy or our legal liability.

These terms are governed by the law of England and Wales, subject to mandatory protections available to consumers in their country of habitual residence. Consumers retain any right to bring proceedings in the courts available to them under applicable law. This clause does not require every UK or French consumer to litigate in England.

Changes to these terms apply to future bookings and purchases. Material changes to an existing contract require agreement or a lawful basis and will not retrospectively reduce rights.
